General Terms and Conditions

EnergyCheck24

General Terms and Conditions

These terms apply to EnergyCheck24’s advisory and intermediary services for consumers and businesses.

1. Scope

These General Terms and Conditions apply to the initiation and performance of EnergyCheck24’s advisory and intermediary services relating to electricity and gas supply contracts for private and business customers.

EnergyCheck24 is the sole proprietorship of Mustafa Aydin and acts as an intermediary. An energy supply contract is concluded exclusively between the customer and the energy supplier selected by the customer.

2. Services provided by EnergyCheck24

On the basis of the information provided by the customer, we review the customer’s energy requirements and research suitable electricity or gas offers. At the customer’s request, we assist with the selection and, after the customer’s express consent, submit the application to the selected energy supplier.

EnergyCheck24 does not itself supply electricity or gas. The respective supplier is responsible for delivery, billing, prices and the terms of the energy supply contract. EnergyCheck24’s statutory duties as an intermediary remain unaffected.

3. Enquiry, intermediary appointment and conclusion of contract

Contacting us or submitting an enquiry through the form is initially non-binding. It does not yet conclude an energy supply contract or a paid intermediary appointment.

A free intermediary appointment is formed only after EnergyCheck24 has communicated a specific offer to the customer, the customer has accepted that offer and has expressly instructed EnergyCheck24 to submit the contract application. EnergyCheck24 then forwards the application to the selected energy supplier on the customer’s behalf.

4. Remuneration

The intermediary service is free of charge for the customer unless a separate fee is expressly agreed in text form in advance.

In the event of a successful referral, EnergyCheck24 may receive remuneration from the energy supplier. This possible remuneration does not alter the fact that the energy supply contract is concluded exclusively between the customer and the supplier.

5. Customer cooperation and documents

The customer provides the information required to review offers and provide intermediary services completely and, to the best of their knowledge, accurately. This may include consumption, delivery address, current tariff and desired contract start date.

Uploaded bills should contain only information required to review the offer. The customer shall inform EnergyCheck24 promptly of any changes to the information provided.

6. Offers and comparison results

Offers and calculations are based on information provided by the customer and on supplier terms available at the time of review. The respective supplier confirms availability and the final contract terms.

Statements about possible savings are calculations or forecasts based on the data and conditions used in each case. A specific saving is owed only if EnergyCheck24 has expressly confirmed it in text form together with the material conditions.

7. Liability

EnergyCheck24 is liable without limitation for intent and gross negligence, for injury to life, body or health, and in all cases of mandatory statutory liability.

In the event of a slightly negligent breach of a material contractual obligation, liability is limited to the foreseeable damage typical for the contract. A material contractual obligation is one whose fulfilment is essential to the proper performance of the intermediary appointment and on whose fulfilment the customer may regularly rely.

The respective energy supplier is responsible for performing the energy supply contract. EnergyCheck24’s own liability for breaches of its intermediary duties remains unaffected.

8. Right of withdrawal for consumers

Consumers generally have a statutory 14-day right of withdrawal for an intermediary contract concluded at a distance, unless a statutory exception applies. The period begins upon conclusion of the contract. Consumers receive the applicable withdrawal notice and model withdrawal form in text form before placing a binding intermediary order.

Withdrawal may be declared by an unequivocal statement to Mustafa Aydin, EnergyCheck24, Dillingenstraße 26, 89134 Blaustein, Germany, or by email to contact@energycheck24.com. To meet the deadline, it is sufficient to send the notice in time.

Model withdrawal form: To Mustafa Aydin, EnergyCheck24, Dillingenstraße 26, 89134 Blaustein, Germany, email contact@energycheck24.com. I/we (*) hereby withdraw from the intermediary contract concluded by me/us (*) for arranging an electricity or gas supply contract. Concluded on: ____. Name of consumer(s): ____. Address: ____. Date: ____. Signature (only if notified on paper): ____. (*) Delete as appropriate.

9. Term and termination

The intermediary appointment ends when the application expressly approved by the customer is submitted or as soon as it is clear that no referral will take place.

The customer may terminate the appointment at any time with effect for the future. Statutory rights of withdrawal and termination remain unaffected.

10. Data protection

EnergyCheck24 processes personal data to handle enquiries, research suitable offers and—after express instruction—to submit the contract application selected by the customer. Details, recipients and retention periods are set out in our Privacy Policy: energycheck24.com/en/privacy-policy-2/.

11. Dispute resolution and final provisions

EnergyCheck24 is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board unless legally required to do so. Mandatory statutory information duties remain unaffected.

German law applies. For consumers, mandatory consumer protection provisions of the state in which they have their habitual residence remain unaffected. Statutory provisions otherwise apply.
